Terms of Sales

Article 1. Purpose

These terms of sale aim to define the contractual relationship between NUTRITION PRO and the Buyer, as well as the conditions applicable to any purchase made through the website www.nutrition-pro.fr. The acquisition of a product through this site implies the Buyer's unreserved acceptance of these terms of sale, which the Buyer acknowledges having read prior to placing an order. Before any transaction, the Buyer declares, on the one hand, that the purchase of products on the website www.nutritionpro.fr has no direct connection with their professional activity and is strictly limited to personal use, and, on the other hand, that they have full legal capacity, allowing them to commit under these General Terms and Conditions of Sale.
NUTRITION PRO reserves the right to modify these terms of sale at any time, in order to comply with any new regulations or to improve the use of its website. As a result, the applicable terms shall be those in force on the date the order is placed by the Buyer.

Article 2. Products

The products offered are those listed on the website www.nutritionpro.fr of NUTRITION PRO. NUTRITION PRO reserves the right to modify the product range at any time. Each product is presented on the website with a description outlining its main characteristics. The photographs are as accurate as possible but are not contractually binding on the Seller.
The prices displayed on the product sheets of the online catalog are in Euros (€), including all taxes (price including VAT), taking into account the VAT rate applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. NUTRITION PRO reserves the right to modify its prices at any time, it being understood that the price displayed in the catalog on the day of the order shall be the only one applicable to the Buyer.

Article 3. Orders and payment terms

Before placing any order, the Buyer may freely purchase as a guest (without being required to create an account) or create an account on the website www.nutritionpro.fr if they wish. The account creation section is directly accessible from the side menu bar. On each visit, the Buyer, if they wish to place an order or consult their account (order status, profile, etc.), must log in using these credentials. NUTRITION PRO offers the Buyer the option to order and pay for products in several steps:
- 100% secure payment by Paypal, Apple Pay, Scalapay, Bancontact, American Express or credit card: the Buyer selects the products they wish to order in the "cart", and modifies them if necessary (quantities, references, etc.). The Buyer then chooses the desired payment method. The next step invites the Buyer to verify all the information, read and accept these General Terms and Conditions of Sale by ticking the corresponding box, and then validate the order by clicking the "Confirm my order" button. Finally, the Buyer is redirected to the secure interface in order to safely enter their Paypal account details or personal credit card information. If payment is accepted, the order is recorded and the contract is definitively formed. Payment by Paypal account or by credit card is irrevocable.
The confirmation of an order entails acceptance of these terms of sale, acknowledgment of full knowledge thereof, and waiver of any right to invoke the Buyer's own purchasing terms. All data provided and the recorded confirmation shall serve as proof of the transaction. If the Buyer has an email address and has provided it on their order form, NUTRITION PRO will send them by email the confirmation of the registration of their order and the delivery information shortly after the order is validated. If the delivery of an order to a home address fails, or if an order delivered to a pickup point is not collected within the allotted time and is returned to the sender, NUTRITION PRO will reship the same order at its own expense to a pre-selected pickup point.

Article 4. Retention of title

NUTRITION PRO retains full and complete ownership of the products sold until the price has been paid in full, including principal, fees and taxes.

Article 5. Liability

In the distance selling process, NUTRITION PRO is bound only by an obligation of means. Its liability cannot be engaged for any damage resulting from the use of the Internet, such as data loss, intrusion, viruses, service interruption, or other involuntary issues.

Article 6. Intellectual property

All elements of the website www.nutrition-pro.fr are and shall remain the exclusive intellectual property of NUTRITION PRO. No one is authorized to reproduce, exploit, or use in any way whatsoever, even partially, any elements of the site, whether in the form of photos, logos, visuals or text.

Article 7. Personal data

NUTRITION PRO undertakes to preserve the confidentiality of the information provided by the Buyer, which they may be required to transmit for the use of certain services. Any information concerning the Buyer is subject to the provisions of French Law No. 78-17 of January 6, 1978 (Loi Informatique et Libertés). Article 8. Dispute resolution

These distance selling terms are governed by French law. For any disputes or litigation, the competent court of jurisdiction shall be that of PONTOISE – TGI (Tribunal de Grande Instance).
